June 1, 2010 is the Federal Trade Commission’s (FTC) deadline to enforce a provision of the “red flags” rule. This requires all physicians adopt and implement written plans for the identification, detection, and response to patterns, practices, or specific activities – known as “red flags” – that could indicate identity theft.

Failure to comply may subject a company to civil monetary penalties up to $2,500 for each independent violation of the rule. Furthermore, a failure to comply will increase a company’s exposure to negligence claims.
