Poyner Spruill has recently prepared and released a business associate agreement (BAA) template in response to the final rules issued by the Department of Health and Human Services to implement the Health Information Technology for Economic and Clinical Health (HITECH) Act. These final rules included changes to the provisions regarding BAAs, meaning that most HIPAA covered entities will have to update existing BAAs.
